New Decision on the Organization and Functioning of the Local Administration of the Municipality of Tivat

The President of the Municipality of Tivat, Željko Komnenović, has adopted a new Decision on the organization and functioning of the local administration of the Municipality of Tivat, which entered into force on September 5, 2025, the day of its publication in the “Official Gazette of Montenegro.” This decision was adopted with the aim of increasing the efficiency of the local administration and aligning it with the current legislative framework and practices, particularly with the amended provisions of the Law on Local Self-Government.

The former Secretariat for Inspection and Communal Supervision has been divided into two separate bodies: the Secretariat for Inspection Affairs and the Municipal Police Service. The Secretariat for Inspection Affairs now also assumes the responsibilities for inspection supervision of the implementation of the Law on Construction of Buildings, carried out by the construction inspector, in accordance with the aforementioned law and regulations governing inspection supervision. In this way, a construction inspection function has been introduced within the local administration, as an organizational part of the Secretariat, enabling more efficient supervision in the field of construction.

A separate Municipal Police Service has been established to carry out tasks within the competence of the municipal police, in accordance with the new Law on Local Self-Government and the Law on Municipal Police. The goal of this reform is to increase efficiency and professionalize operations in the field of communal supervision.

The existing Service for Investor Relations has been upgraded to the Secretariat for European Integration and Strategic Investor Relations, following the initiative of the Ministry of European Affairs, with the aim of strengthening the capacities of local governments for active participation in the European integration process. At the end of 2023, the Ministry signed a Memorandum of Cooperation with all Montenegrin municipalities, including Tivat, defining future collaboration on joint initiatives and projects in the field of European integration. The Municipality of Tivat responded to this initiative by establishing a dedicated Secretariat, which provides an institutional framework for working on European projects and cooperating with strategic investors.

The Secretariat for Spatial Planning has been renamed the Secretariat for Spatial Planning and Development under the new applicable laws: the Law on Construction of Buildings, the Law on Spatial Planning, and the Law on Legalization of Illegal Buildings. In addition to its previous responsibilities, this Secretariat has now assumed tasks related to calculating fees for communal infrastructure of construction land – for both legal and illegal buildings – which was previously under the Directorate for Investments. This body now has the authority to conduct administrative procedures for issuing building permits. In the future, the Agency for Construction and Development of Herceg Novi is expected to take over spatial planning tasks, consolidated for all three municipalities in the Boka region: Tivat, Kotor, and Herceg Novi.

The Directorate for Property has been renamed the Directorate for Property and Legal Representation.

The local administration now consists of eight secretariats, two directorates, three independent services, and three professional services.
