Penalties for illegal waste dumping and attacks on official personnel

Officials from the Secretariat for Inspection and Communal Supervision of the Municipality of Tivat have been conducting inspections in recent days to monitor illegal dumping of soil, rubble, and other waste in areas not designated for such activities. Acting on citizen reports and in accordance with the powers granted by the Law on Communal Activities, the communal police encountered an offender (LJ.I.) on January 30th who was unloading waste from a truck on land near the Krtoljska intersection. A misdemeanor citation was issued to this individual in accordance with the Law. The Secretariat emphasizes that they will intensify inspections in this regard in the coming period and urge citizens to respect waste disposal rules to contribute to environmental preservation.

During the previous period, cases were recorded where Municipal Police officers were obstructed from carrying out official duties by subjects of communal supervision who refused to provide personal documents upon request. Misdemeanor citations were issued to these individuals in accordance with the Law on Municipal Police.

“At the end of the year, we also had two incidents where municipal police officers were forced to use force against subjects of communal supervision. Officers acted in accordance with the law. We will not tolerate attacks on official personnel, especially considering that they carry out demanding and responsible tasks in the interest of all citizens,” emphasized Krsto Pejović, the Secretary of the Secretariat for Inspection and Communal Supervision.

He noted that one of these incidents occurred in the area of the Gradiošnica local community, and the individual L.R. was prosecuted for assaulting an official, with the case being before the competent court in Kotor. The second case of an attack on official personnel occurred in Arsenalska Street by an individual named P.O. A misdemeanor procedure was initiated in the court for insults and derogatory behavior towards the official.

Officials from the Secretariat for Inspection and Communal Oversight have, in the past period, conducted inspections of waste deposition outside designated areas based on citizens’ reports and in accordance with the powers granted by the Law on Communal Activities and the Decision on Communal Order. On this occasion, utilizing video footage and photographs provided by citizens on-site, authorized personnel were able to identify the perpetrators of this offense. Legal proceedings were initiated against them, and misdemeanor fines were issued accordingly.

The municipal secretariat urges citizens to respect designated waste disposal areas, thus contributing to environmental preservation.

Additionally, inspections were carried out at the construction site near the “Nikki Beach” hotel, with a focus on vehicles exiting onto municipal roads without prior wheel cleaning, resulting in significant pollution of the local thoroughfare. Offenders were issued misdemeanor fines and instructed to clean the public area and restore it to its previous functional state.

Removed Garages in Njegoševa Street

Officials from the Secretariat for Inspection and Communal Oversight of the Municipality of Tivat have carried out the administrative execution of decisions instructing unidentified individuals to remove temporary structures – three prefabricated parking garages located on cadastral parcel 2286/1, cadastral municipality of Tivat, in Njegoševa Street, behind residential buildings. No ownership was established for these three temporary structures. In accordance with the Law on Inspection Oversight, the garages were removed by the construction company “Tecta inženjering” LLC from Podgorica, whose workers completely dismantled the material and cleared the location.

The municipality of Tivat plans to construct an open-air green market at this location, and funds for the necessary documentation and resolution of property and legal issues are envisaged in the Draft Budget for the year 2024.

Abandoned Vehicles Removal Action

The Municipal Police, in accordance with the authorities granted by the Decision on Communal Order, has initiated an action to control vehicles that have been present on public surfaces in the same location for more than seven days, are not in use due to wear and tear and damage, do not have license plates, are unregistered, etc. The Secretariat urges those who own such vehicles to remove them within the period specified by the municipal police officer in a prominently displayed order on the vehicle or part of the vehicle. Otherwise, after the inspection process, removal will be carried out at the owner’s expense through a third party.

Penalties for those who leave their belonging to”reserve” a place on the beach

The Secretariat for Inspection and Communal Supervision of the Municipality of Tivat and the Tivat Municipal Company organized several joint actions to remove towels, plastic bottles and other objects with which visitors to Tivat’s beaches try to “reserve” a place for themselves for the next day. The local administration says that it will not tolerate this phenomenon and appeals to citizens not to leave the aforementioned items on the beaches, especially bearing in mind that the fine for this offense is €100 for individuals and up to €7,000 for legal entities.

Communal Police officers warn beach users that those who leave these items on the beaches will be fined, and the items will be removed from the beach. The Secretariat for Inspection and Communal Supervision announces that they will continue with further actions to suppress this phenomenon.
